Criminal Convictions
South Devon College is an educational establishment that provides education to children and/or vulnerable adults. Therefore the College needs to assess your suitability for the position you are applying for and is entitled to ask questions about your criminal record. The amendments to the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (2013 and 2020) provides that when applying for certain jobs and activities, certain convictions and cautions are considered ‘protected’. This means that they do not need to be disclosed to employers, and if they are disclosed, employers cannot take them into account. Guidance about whether a conviction or caution should be disclosed can be found on the Ministry of Justice website. To determine whether your conviction or caution is protected, and whether you are required to disclose it should your application be shortlisted, you can also refer to Nacro or Unlock websites. South Devon College aims to promote equality of opportunity for all job applicants with the right mix of skills and potential. We welcome applications from a diverse and representative community. A criminal record will not necessarily be a bar to obtaining employment. Each case is considered on its own merit.
